Foty Law Group is raising concerns about whether Green Thumb Industries (GTI) employees are being properly compensated for time spent undergoing mandatory security screenings before and after their scheduled shifts.
According to the law group, some GTI workers are required to arrive before their shifts and wait in line for security screenings before they are allowed to clock in. At the end of their shifts, employees may be required to clock out before undergoing another screening to leave the facility.
The issue centers on whether this required time qualifies as compensable work under federal labor law.
The Fair Labor Standards Act (FLSA) requires employers to compensate eligible employees for time considered hours worked. Whether time spent waiting for and undergoing security screenings must be paid depends on the circumstances and applicable legal standards.
Foty Law Group states that current and former GTI employees who underwent mandatory security screenings without compensation may be entitled to recover unpaid wages.
For cannabis workers, the issue highlights a broader question about workplace practices across an industry where security procedures are common. Employees should understand their rights regarding required pre-shift and post-shift activities, including time spent waiting to complete employer-mandated procedures.
