Illinois Cannabis Arrests Rise After Legalization Report Finds Highest Rate Among Legal States

The Marijuana Policy Project, a leading national organization focused on cannabis policy reform, has released a detailed report examining cannabis arrests across the United States. The findings highlight a surprising trend in Illinois that sets it apart from other states with legal adult use cannabis.

States with Legal cannabis sales saw less arrests

Using data from the Federal Bureau of Investigation Crime Data Explorer along with arrest data compiled by the American Civil Liberties Union, the report shows that Illinois is the only legalization state where cannabis possession arrests have increased since legalization. While the rise is relatively small at 3.4 percent, it stands in contrast to most other legal states, where arrests have declined. On average, about 15 people are arrested each day in Illinois for cannabis related offenses.

The report also found that Illinois now has the highest cannabis arrest rate per capita among all states where cannabis is legal. In 2025, there were 54.16 cannabis related arrests for every 100,000 residents. That rate is higher than in several states where cannabis remains illegal, including Hawaii, Florida, and New Hampshire.

Part of the reason for this trend may lie in how Illinois regulates cannabis. Unlike many other legal states, Illinois does not allow adult use consumers to grow cannabis at home. The state also maintains strict rules for transporting cannabis in a motor vehicle. Products must be kept in a secured, sealed or resealable, odor proof, and child resistant container that is not accessible while driving.

Violating these requirements can lead to serious legal consequences. An improperly stored cannabis product can result in a Class A misdemeanor, which carries penalties of up to 364 days in jail, fines up to $2,500, and potential probation. Before legalization, similar violations were often treated as minor civil offenses with far less severe penalties.

Due in part to these strict regulations, Illinois continues to see a high number of cannabis possession arrests each year, with totals exceeding 5,000 annually. The report raises important questions about how legalization is being implemented and enforced, and whether current policies are aligning with the intended goals of reform.
